Terms of Service

1. Acceptance of Terms

By accessing this website, placing an order, or engaging JASTRICKS for any service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use our services or website.

These Terms apply to all clients, website visitors, and any person or organisation that interacts with JASTRICKS in a commercial capacity. These Terms are effective from the date you first engage our services.

We reserve the right to update these Terms at any time. Continued use of services following notification of changes constitutes acceptance.

2. Services Description

JASTRICKS provides custom engineering simulation and design services including but not limited to:

• Computational Fluid Dynamics (CFD) analysis
• Finite Element Analysis (FEA) and structural simulation
• Thermal and heat transfer simulation
• CAD modelling and geometry preparation
• Multi-physics and coupled simulations
• Technical documentation, reports, and animation rendering

All services are delivered digitally. No physical hardware or materials are supplied. Service scope is defined at the order stage and confirmed via email before work commences.

3. Placing Orders

An order is initiated when you complete the order form on this website and receive a confirmation email. Project commencement is subject to:

• Receipt of all required project files and information (CAD, specifications, boundary conditions)
• Payment of the agreed upfront deposit (typically 50%)
• Written confirmation from JASTRICKS that the project scope is feasible

JASTRICKS reserves the right to decline any order that is outside our technical capability, involves illegal applications, or where insufficient information is provided.

Any changes to the project scope after work has begun may result in additional charges and revised delivery timelines, communicated and agreed in writing before changes are implemented.

4. Payment Terms

Our standard payment structure is:

• 50% upfront deposit — required before project kick-off
• 50% on delivery — required before final files are released from Drive access

Accepted payment methods include bank transfer, mobile money (M-Pesa), and other mutually agreed methods. All prices are quoted in KES (Kenyan Shillings) or USD as agreed. Prices are exclusive of any applicable taxes unless stated otherwise.

Non-payment of the final balance within 14 days of delivery notification will result in revocation of Drive access. Late payments beyond 30 days may incur an administrative fee.

5. Delivery & Timelines

Estimated delivery timelines are provided at the order stage. These are good-faith estimates and may be affected by:

• Complexity of the simulation and number of solver iterations required for convergence
• Availability and response time of the client for technical clarifications
• Delays in receiving required project files from the client
• Hardware availability and compute queue

JASTRICKS will communicate any delays promptly via email. We are not liable for losses arising from delivery delays caused by factors outside our direct control.

Deliverables are provided via Google Drive folder access. Final files remain in your accessible folder for a minimum of 30 days after delivery. You are responsible for downloading and archiving your deliverables within this period.

6. Intellectual Property

Client-owned IP: All CAD models, technical drawings, specifications, and proprietary data you provide remain exclusively your intellectual property. JASTRICKS claims no ownership over any material you supply.

Deliverable IP: Upon full payment, you receive full ownership rights to all simulation results, reports, and rendered outputs produced specifically for your project.

JASTRICKS-owned content: Our methodology, solver configurations, post-processing templates, scripts, and any internal tooling developed by JASTRICKS remain our intellectual property and are not transferred as part of any project delivery.

Portfolio rights: Unless you explicitly request otherwise in writing, JASTRICKS reserves the right to use anonymised or non-proprietary visual outputs (e.g., flow visualisations with geometry concealed) for portfolio and marketing purposes. We will always confirm with you before using any client-specific identifiable content.

7. Confidentiality

Both parties agree to treat all technical, commercial, and project-specific information exchanged as strictly confidential. Specifically:

• JASTRICKS will not disclose your project details, geometry, or results to any third party without your written consent
• All team members with access to your project are bound by confidentiality obligations
• This obligation survives the completion or termination of any project engagement

If a Non-Disclosure Agreement (NDA) is required, contact us before placing your order and we will accommodate this in the engagement terms.

8. Limitation of Liability

JASTRICKS provides simulation results for engineering analysis and informational purposes. We do not certify, approve, or officially validate designs for regulatory compliance unless explicitly contracted as a formal certification service.

Simulation results are as accurate as the inputs, boundary conditions, and meshing parameters provided or agreed during the project brief. JASTRICKS is not liable for:

• Engineering decisions made based on our simulation outputs
• Physical product failures in manufactured goods
• Losses arising from regulatory non-compliance where independent certification was not engaged
• Consequential, indirect, or incidental damages of any nature

Our maximum liability in any case is limited to the fees paid for the specific project in question. By engaging our services you accept this limitation.

9. Acceptable Use

You agree not to use JASTRICKS services for:

• Any illegal purpose or in violation of applicable laws
• Weapons development, surveillance, or other defence applications without prior explicit written agreement
• Submitting false, misleading, or malicious project information
• Attempting to reverse-engineer or extract JASTRICKS' methodologies beyond the deliverables you own
• Reselling JASTRICKS deliverables as your own simulation service without prior agreement

Violation of these terms may result in immediate termination of service and forfeiture of any deposit paid.

10. Changes & Amendments

JASTRICKS reserves the right to amend these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. For active projects, any material changes to terms will be communicated directly. Continued use of services after notification constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.
